These Terms & Conditions (“Terms”) govern the use of the toll plaza payment services (“Service”) provided by SUSTAIN FOCUZ TECH PRIVATE LIMITED (“SustainFocus”, “we”, “our”, or “us”) through its website www.sustainfocus.in. By accessing or using this Service, you agree to be bound by these Terms.
 

1. Service Overview

1.1 SustainFocus facilitates toll payments through authorized and compliant digital payment systems.

1.2 SustainFocus is not a toll operator. We act as a third-party technology enabler between users and the toll authorities or banks.

1.3 SustainFocus does not determine toll rates, levy toll charges, or control the operational timelines of toll plazas.
 

2. User Eligibility & Account Setup

2.1 You must be at least 18 years old and legally competent to use this Service.

2.2 You agree to provide true, complete, and up-to-date information while registering on the platform.

2.3 You are responsible for ensuring that your registered mobile number, vehicle details, and payment methods are valid and accessible.
 

3. User Responsibilities

3.1 You agree not to use the service for any fraudulent, unlawful, or unauthorized purposes.

3.2 You are solely responsible for entering accurate information (vehicle registration, toll location, amount, etc.). SustainFocus is not liable for errors resulting from incorrect input.

3.3 You shall not attempt to reverse-engineer, hack, or disrupt any part of the platform or service.
 

4. Payment and Transaction Terms

4.1 Payments are processed via authorized payment gateways and banking partners. SustainFocus is not liable for delays or failures caused by payment processors, toll plaza systems, or banks.

4.2 Transactions may be declined due to technical errors, insufficient balance, mismatched vehicle tags, or regulatory issues.

4.3 All transactions are logged, and SustainFocus may share data with banks, regulators, or toll operators for reconciliation or audit purposes.

4.4 In case of transaction failure after debit, refunds (if applicable) will be processed in line with our Refund Policy – Toll Plaza Payment.
 

5. Compliance with Legal and Regulatory Requirements

5.1 You acknowledge that toll payments are regulated under government and transport authority mandates, and you shall comply with all applicable laws and rules while using the Service.

5.2 SustainFocus reserves the right to report suspicious or illegal activity to law enforcement or regulatory bodies as required under law.

5.3 The platform is compliant with applicable Indian data privacy and cyber laws including but not limited to the Information Technology Act, 2000.
 

6. Cancellation, Refund, and Dispute Resolution

6.1 If a payment fails but the amount is deducted, we will coordinate with payment gateways and the respective toll authority to ensure resolution.

6.2 You may raise disputes or requests via email at info@sustainfocus.in or by calling our helpline.

6.3 Refunds, where applicable, will be made to the original source of payment and are subject to confirmation from toll authorities.
 

7. Suspension or Termination

7.1 We may suspend or terminate your account for any of the following reasons:

• Providing false information

• Breach of terms

• Fraudulent activity

• Misuse of platform services

7.2 Any pending refunds or services shall be handled as per applicable law and internal policy at the time of termination.
 

8. Limitation of Liability

8.1 SustainFocus shall not be liable for:

• Incorrect toll deductions due to user error

• Delays in toll clearance due to system downtime, bank issues, or authority-side failures

• Non-compliance with FASTag or vehicle registration guidelines

• Unauthorized access to your account due to your negligence

8.2 In no event shall our total liability exceed the transaction amount paid by you for the specific toll transaction in dispute.
 

9. Indemnification

You agree to indemnify and hold harmless SustainFocus, its directors, officers, employees, and service providers against all claims, losses, damages, liabilities, and legal costs arising from:

• Breach of these terms

• Unauthorized or fraudulent use of the platform

• Any violation of applicable laws during the use of this service
   

10. Data Privacy

Your data will be collected, stored, and used in accordance with our Privacy Policy. We use this information only to process payments, provide customer support, and comply with legal requirements.
 

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. All disputes shall be subject to the jurisdiction of the competent courts located in Pune, Maharashtra, India.
